WHAT ARE THE CDM 2015 REGULATIONS?

The current variant of the regulations, CDM2015, came into force on 6th April 2015 and are the 3rd iteration of the rules.  These regulations strengthen previous UK construction health and safety measures ensuring that health and safety issues are appropriately acknowledged throughout a project’s development.

So that the risk of injury to those who must build, use and maintain structures is lessened. The Regulations dictate that a “Principal Designer” needs to be appointed where greater than one contractor will be operating on a project at any one time. 

Domestic clients are no longer excluded, with the duties falling to the contractor or Principal Contractor where more than one is present on site. These duties can be assigned to the Principal Designer (where appropriate) or to the Principal Contractor).

PRINCIPAL DESIGNERS (PD)

CDM2015 necessitates a designer to tackle the PD (Principal Designer) job for health and safety on projects.

We offer a complete Principal Designer service for lead-consultants or other designers designated to a Principal Designer role (CDM-PD) by a customer. This service gives expert guidance and direction on the CDM2015 statutes to ensure the PD can offer project health and safety duties efficiently. Our package of ‘essential’ CDM-PD services incorporates: 

  • Advice and direction for regulation compliance.
  • Health and Safety revision of drawings and specs.
  • Provision of PCI (Pre-construction Information)  for tendering contractors.

We can ‘intensify’ our service throughout the project:

  • Develop construction phase plans. 
  • Furnish advice and guidance on access and maintenance for structures in use.
  • Monitor and study method statements and risk assessments.
  • Advise on information to be presented by designers. 

After the project, we can likewise arrange the Health and safety file for the project.

CDM 2015 – CLIENTS DUTIES

Client duties are more focused in CDM2015. The new regulation acknowledges the value of the client as the head of the supply chain. Customers are best situated to set health and safety standard during the project. Most projects will include client discharging duties under CDM. 

As a client, you, therefore, must appoint a Principal Designer (PD) from the current design team on projects where greater than one contractor is predicted on-site. You must also pick a Principal Contractor.

If you do not make these selections, you will be considered, as the Client, to be taking on these tasks yourself.

A client’s additional duties include submission of an F10 to the HSE, provision of data to the PD for the expectations of pre-construction Information, responsibilities concerning welfare provision during the project. Also, clients need to ensure those they select are competent.

If we are implementing another service now for the project, we can also be selected to serve as the PD. Alternatively, suppose you chose as the client to take on these responsibilities yourself. In that case, we can offer a CDM consultancy service to provide this expertise and carry out the role on your behalf.

Although the PD replaces the previous CDM-C role, the PD is not obligated to provide clients with health and safety guidelines or ensure they comply with their obligations under CDM2015. We think that clients want and value a CDM advisor to assist them in complying with health and safety regulations, and we can extend this service.

DESIGNERS

Suppose you are appointed as ‘Principal Designer’ (PD) by a client. In that case, you will be expected to undertake most of the duties currently administered by the CDM Coordinator.

Including:

  • Pre-construction H&S Co-ordination;
  • Preparation/collation of the Pre-Construction Information (PCI);
  • Preparation/collation and issue of the H&S File (HSF) after the project;

Suppose you are a design practice that does not have the necessary in-house capabilities to accomplish the CDM/H&S viewpoints of the new Principal Designer role. In that case, we can provide a CDM consultancy service to fulfil this role on your account as part of your organisation.

CONTRACTORS

For residential clients where no Principal Designer is elected, you will be expected to assume the responsibilities of the PD (including PCI and HSF).
You will require a Construction phase plan for ALL projects where you use different contractors, irrespective of project scope or duration.

Our CDM advisors can help with the formation of these plans on all sizes of construction projects. Our CDM portal system is another valuable tool for contractors.

It recognises if a project is notifiable or not and leads the contractor through the appropriate process so that all related property information is produced (Asbestos, H&S File etc.) and ensures critical risks are recognised, adequate control actions are in place. That suitable documentation is organised for each project also.

CDM INFORMATION & PLANS

Following the debut of CDM in 1995, we have formed efficient and practical means of collating pre-construction information to be given to the Contractor.
In collating this data, we can work with design teams and different project stakeholders to produce a ‘hazard register’ which is refreshed as the project proceeds. This is the HSE-preferred process of identifying and coping with hazards. It provides a practical record which permits us to bestow our pre-construction information clearly and succinctly.

For smaller projects, we propose a ‘small works plan’ CDM portal. This is a frequently overlooked feature added in the CDM2007 regulations, where clients now have duties to ensure contractors’ orders are in place before the contractor starting on site.

Under CDM2105, this is particularly relevant where coordination is needed if more than one contractor is on site. We propose a cost-effective and candid system for dealing with these projects, and this has shown to be very helpful and popular with clients.

HEALTH & SAFETY FILES
